All rental items remain the property of Quabalexphim at all times. The renter is responsible for the care and safekeeping of all rented items from the time of delivery until the time of pickup. Any damage to or loss of rental items will be charged to the renter at replacement cost. The renter agrees to use rental items only for their intended purpose and in a safe and appropriate manner.
Rental periods are calculated from the date of delivery to the date of pickup. Late returns may incur additional charges. The renter must provide accurate delivery and pickup information and ensure that someone is available to receive and return the items at the scheduled times. We reserve the right to refuse service or cancel any rental agreement at our discretion.
Payment is required in advance of delivery unless other arrangements have been made in writing. We accept various forms of payment as indicated on our website or during the booking process. All prices are subject to change without notice. A deposit may be required for certain rental items, which will be refunded upon satisfactory return of the items in their original condition.
In the event of damage or loss, the renter authorizes us to charge the payment method on file for the cost of repair or replacement. Any disputes regarding charges must be raised within thirty days of the charge date.
Delivery and pickup times are estimates and may vary due to traffic, weather, or other unforeseen circumstances. We will make reasonable efforts to meet scheduled times but cannot guarantee exact timing. The renter must provide clear access to the delivery location and ensure that the venue permits the delivery and setup of rental items.
Additional charges may apply for difficult access, stairs, long carries, or other special circumstances. The renter is responsible for obtaining any necessary permits or permissions required for the delivery and use of rental items at their chosen venue.
Cancellations must be made in writing via email or through our website. Cancellation fees may apply depending on how far in advance the cancellation is made. We reserve the right to cancel any rental agreement due to circumstances beyond our control, including but not limited to severe weather, equipment failure, or other emergencies. In such cases, we will provide a full refund of any payments made.
The renter agrees to indemnify and hold harmless Quabalexphim, its owners, employees, and agents from any claims, damages, losses, or expenses arising from the renter's use of rental items. We are not liable for any injuries or damages that occur as a result of the use or misuse of rental items. The renter assumes all risk associated with the use of rental items.
Our liability for any claim arising from a rental agreement is limited to the total amount paid by the renter for that specific rental. We are not liable for any indirect, incidental, consequential, or punitive damages.
These Terms of Use and your use of the website are governed by and construed in accordance with the laws of the State of California applicable to agreements made and to be entirely performed within the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms of Use will be brought exclusively in the federal or state courts located in San Mateo County, California.
Any dispute arising from these Terms of Use or your use of the website shall first be attempted to be resolved through good faith negotiations. If negotiations fail, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Mateo County, California, and judgment on the award may be entered in any court having jurisdiction.
